Welcome to DOSHE.

DOSHE is a creative commerce ecosystem designed to connect independent creators with people seeking original, authentic, and individually created work.

By accessing or using doshe.store, creating an account, opening a store, listing a product, purchasing a product, or otherwise using DOSHE services, you agree to these Terms and Conditions and all applicable DOSHE policies.

Please read these Terms carefully before using the Platform.

1. GENERAL OVERVIEW

1.1. The DOSHE Ecosystem

DOSHE provides a technology-based ecosystem through which independent creators can present, promote, and sell eligible original and handmade products to buyers.

DOSHE provides the digital infrastructure that facilitates discovery, communication, transactions, payments, and other related services.

1.2. Independent Sellers

Products offered through DOSHE are generally offered and fulfilled by independent sellers.

Unless expressly stated otherwise, DOSHE does not manufacture, produce, own, warehouse, package, or ship products offered by independent sellers.

The seller is responsible for the product, the accuracy of the listing, fulfillment of the order, and compliance with applicable laws and DOSHE policies.

1.3. Acceptance of Terms

These Terms apply to buyers, sellers, visitors, and other users of DOSHE.

By using DOSHE, you acknowledge that you have read, understood, and agreed to these Terms and the policies incorporated into them.

2. ELIGIBILITY AND USER ACCOUNTS

Users must have the legal capacity to enter into binding agreements under applicable law.

Users must provide accurate, complete, and current information when registering or using DOSHE.

Users are responsible for maintaining the security of their accounts and login credentials.

Users may not:

* impersonate another person or business;
* create accounts using false information;
* provide fraudulent verification documents;
* use another person’s account without authorization;
* use DOSHE for unlawful or fraudulent purposes.

DOSHE may request additional information when reasonably necessary to verify identity, protect users, prevent fraud, or comply with applicable law.

3. SELLER VERIFICATION

Seller verification is mandatory before a seller may receive payouts through DOSHE.

Verification may include, where applicable:

* identity verification;
* contact information;
* banking information;
* tax information;
* business information;
* Stripe verification requirements;
* evidence of authorship or creative activity;
* photographs or videos of the creative process;
* workshop or production information;
* information concerning production partners.

DOSHE may request additional reasonable evidence when necessary to determine whether a seller or product complies with DOSHE policies.

Providing false or misleading verification information may result in listing removal, payout restrictions, suspension, or termination of the seller’s account.

4. ORIGINALITY AND HANDMADE REQUIREMENTS

DOSHE exists to support independent creativity and original work.

Products represented as handmade must genuinely meet DOSHE’s applicable handmade and authenticity standards.

Mass-produced or factory-produced goods may not be falsely represented or sold as handmade products.

Sellers must accurately disclose the nature, origin, production method, and material involvement of third parties where required.

Reselling mass-produced products as the seller’s own handmade work is prohibited.

DOSHE reserves the right to request evidence of the creative or production process and to remove products that do not meet DOSHE standards.

Detailed requirements are governed by the DOSHE Handmade & Authenticity Policy.

5. SELLER RESPONSIBILITIES

Sellers are solely responsible for the products they offer through DOSHE.

Sellers must ensure that:

* product descriptions are truthful and accurate;
* photographs reasonably represent the actual product;
* prices and applicable charges are clearly disclosed;
* materials and dimensions are accurately described;
* production and processing times are reasonably stated;
* products comply with applicable safety requirements;
* intellectual property rights are respected;
* shipping information is accurate;
* required disclosures are provided;
* applicable laws and regulations are followed.

Sellers are responsible for obtaining licenses, permits, registrations, or authorizations required for their activities.

6. SHIPPING AND DELIVERY

Unless otherwise expressly stated, sellers are responsible for arranging and managing shipment of their products.

Sellers are responsible for:

* appropriate packaging;
* accurate shipping information;
* selecting appropriate carriers;
* communicating processing times;
* providing tracking information where available;
* complying with customs and international shipping requirements.

DOSHE does not control independent shipping carriers and cannot guarantee carrier delivery dates.

International purchases may be subject to customs duties, import taxes, tariffs, brokerage fees, or other government charges.

Responsibility for such amounts is determined by applicable law and the terms disclosed in connection with the transaction.

7. BUYER RESPONSIBILITIES

Buyers are responsible for reviewing the product description, price, dimensions, materials, processing time, shipping information, seller policies, and other relevant information before purchasing.

Buyers must provide accurate payment, contact, and delivery information.

Buyers may not:

* make fraudulent purchases;
* intentionally submit false claims;
* misuse chargebacks;
* provide fraudulent evidence;
* manipulate reviews;
* harass or threaten sellers;
* use DOSHE for unlawful purposes.

Buyers should promptly notify the seller when a legitimate problem arises with an order.

8. DOSHE PLATFORM FEE

Opening a standard store on DOSHE is free.

DOSHE charges a 5% Platform Fee on each completed sale processed through the DOSHE ecosystem.

The 5% Platform Fee compensates DOSHE for providing and operating the technology, infrastructure, services, and ecosystem through which transactions are facilitated.

The DOSHE Platform Fee is separate from payment-processing fees charged by Stripe or other amounts imposed by third parties or government authorities.

9. STRIPE PAYMENT PROCESSING FEES

DOSHE uses Stripe as its payment infrastructure provider.

Payments and seller payouts may be processed through Stripe and Stripe Connect.

Stripe may charge payment-processing fees and, depending on the transaction and account configuration, other applicable fees, including fees associated with payouts, international payments, currency conversion, disputes, or other payment services.

Stripe fees are separate from DOSHE’s 5% Platform Fee and are not DOSHE commissions.

Where applicable, Stripe fees may be deducted from transaction proceeds before the remaining balance is paid to the seller.

Stripe’s actual fees may vary depending on factors including:

* payment method;
* transaction type;
* seller country;
* buyer country;
* currency;
* currency conversion;
* payout method;
* Stripe account configuration;
* Stripe pricing in effect at the time of the transaction.

DOSHE does not guarantee that Stripe’s fees will remain at any particular percentage or amount.

Where technically and legally applicable, DOSHE will provide sellers with information concerning deductions associated with their transactions.

10. PAYOUTS

Payouts are available only to sellers who have successfully completed all verification requirements applicable to their accounts.

Seller payouts are processed using Stripe’s payment infrastructure.

The timing of a payout may depend on:

* Stripe processing requirements;
* banking schedules;
* account verification;
* transaction risk;
* refunds;
* disputes or chargebacks;
* applicable legal requirements;
* country-specific payment rules.

DOSHE does not guarantee that every payout will reach a seller’s bank account within a fixed number of business days because payment processing may depend on Stripe, financial institutions, and other circumstances outside DOSHE’s reasonable control.

DOSHE may temporarily restrict or delay a payout where reasonably necessary to investigate fraud, resolve a transaction dispute, comply with law, address a chargeback, or protect users and the integrity of the Platform.

11. RETURNS, REFUNDS AND CANCELLATIONS

Independent sellers may establish their own return, exchange, and cancellation policies, subject to applicable law and minimum DOSHE requirements.

A seller’s policy cannot eliminate consumer rights that cannot legally be waived.

Buyers should review the applicable seller’s policy before completing a purchase.

Certain categories, including personalized, custom-made, made-to-order, perishable, or digital products, may be subject to different return or cancellation conditions where permitted by law.

12. DISPUTES BETWEEN BUYERS AND SELLERS

Buyers and sellers should first make a reasonable effort to resolve transaction-related issues directly.

If the parties cannot reach a resolution, either party may request review by DOSHE where the transaction qualifies under DOSHE policies.

DOSHE may review available evidence, including:

* product listings;
* order information;
* communications;
* payment records;
* photographs and videos;
* tracking information;
* delivery confirmation;
* other relevant evidence.

Based on the evidence and applicable DOSHE policies, DOSHE may facilitate or administratively resolve a dispute within the scope of its contractual and technical authority.

DOSHE may take appropriate Platform-level action, including facilitating a refund, restricting funds, removing a listing, or restricting an account where permitted by applicable agreements, payment-provider rules, and law.

DOSHE’s internal decision is not a judicial determination and does not eliminate legal rights that cannot lawfully be waived.

13. PROHIBITED ACTIVITIES

Users may not:

* sell illegal or prohibited products;
* sell counterfeit products;
* misrepresent mass-produced products as handmade;
* infringe copyrights, trademarks, patents, or other rights;
* engage in fraud;
* manipulate transactions;
* manipulate reviews or ratings;
* provide intentionally misleading product information;
* distribute malware or malicious content;
* interfere with Platform security;
* harass other users;
* use DOSHE to facilitate unlawful activity;
* attempt to circumvent applicable DOSHE fees in violation of DOSHE policies.

DOSHE may maintain additional Prohibited & Restricted Items requirements.

14. INTELLECTUAL PROPERTY

Creators retain ownership of intellectual property they legally own in their original works.

Uploading content to DOSHE does not transfer ownership of that intellectual property to DOSHE.

By uploading photographs, videos, descriptions, artwork, logos, or other content, users grant DOSHE a non-exclusive, worldwide, royalty-free license, for the period reasonably necessary to provide and promote DOSHE services, to host, display, reproduce, format, translate, distribute, and use that content for legitimate Platform operations and promotion.

Users must possess the rights necessary to upload and use their content.

Copyright and trademark complaints are handled under the DOSHE Intellectual Property & DMCA Policy.

15. REVIEWS AND COMMUNICATIONS

Reviews must represent genuine experiences.

Fake reviews, purchased reviews, coordinated review manipulation, threats intended to influence reviews, and fraudulent ratings are prohibited.

DOSHE may moderate or remove reviews or other content that violates DOSHE policies or applicable law.

16. ACCOUNT SUSPENSION AND TERMINATION

DOSHE may restrict, suspend, or terminate an account where reasonably necessary because of:

* fraud;
* serious or repeated violations of DOSHE policies;
* sale of prohibited products;
* counterfeit goods;
* misrepresentation of mass-produced products as handmade;
* intellectual property violations;
* false verification information;
* payment risk;
* abuse of users;
* security threats;
* legal or regulatory requirements.

Serious violations may result in immediate action without advance notice where permitted by law.

Users may request closure of their accounts through DOSHE support, subject to unresolved transactions, disputes, legal retention requirements, and other outstanding obligations.

17. ROLE AND LIMITATION OF DOSHE

DOSHE provides the infrastructure through which independent buyers and sellers can discover one another and transact.

DOSHE does not guarantee:

* product quality;
* commercial success of a seller;
* sales volume;
* buyer demand;
* continuous Platform availability;
* performance of independent shipping carriers;
* performance of independent sellers;
* uninterrupted operation of third-party services.

However, DOSHE may establish standards, verify sellers, moderate content, investigate violations, review disputes, and take reasonable measures to protect the integrity of the ecosystem.

Nothing in these Terms excludes responsibilities that DOSHE cannot legally disclaim.

18. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, DOSHE will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages resulting from use of the Platform or transactions between independent users.

Nothing in these Terms limits liability where such limitation is prohibited by applicable law.

19. INDEMNIFICATION

To the extent permitted by applicable law, users agree to indemnify and hold harmless the legal entity operating DOSHE and its officers, directors, employees, representatives, and agents from third-party claims, liabilities, losses, and reasonable costs arising from:

* products offered by the user;
* infringement of third-party rights;
* unlawful conduct;
* fraudulent activity;
* material violation of these Terms;
* material violation of applicable law.

20. PRIVACY AND DATA PROTECTION

DOSHE processes personal information in accordance with the DOSHE Privacy Policy and applicable privacy laws.

Payment information may be processed directly by Stripe.

DOSHE does not represent that it stores complete payment-card information when that information is processed directly by an authorized payment provider.

21. THIRD-PARTY SERVICES

DOSHE may rely on independent third parties for payment processing, hosting, communications, analytics, shipping integrations, identity verification, security, and other services.

Third-party services may be governed by their own terms and privacy policies.

DOSHE is not responsible for acts or failures of independent third-party services outside DOSHE’s reasonable control.

22. CHANGES TO THESE TERMS

DOSHE may update these Terms to reflect changes in:

* applicable law;
* Platform functionality;
* payment infrastructure;
* security requirements;
* business operations;
* DOSHE policies.

Where required by law or appropriate because of a material change, DOSHE will provide reasonable notice.

The current version and effective date will be published on doshe.store.

23. GOVERNING LAW

These Terms are governed by the laws of the State of California and applicable federal laws of the United States, without regard to conflict-of-law principles, except where mandatory consumer protection laws require otherwise.

Nothing in these Terms deprives a consumer of non-waivable protections
