1. INTRODUCTION
These Terms of Service (“Terms”) govern access to and use of the DOSHE ecosystem, including doshe.store and the services, features, technologies, tools, communications, and transaction infrastructure made available through DOSHE (collectively, the “Services”).
DOSHE is a creative commerce ecosystem designed to connect independent creators with people seeking original work, creativity, craftsmanship, and individual talent.
By accessing or using DOSHE, creating an account, opening a store, listing a product, making a purchase, or otherwise using the Services, you agree to these Terms, the DOSHE Terms and Conditions, and all other policies applicable to your activities.
If you do not agree, you should not use the Services.

2. THE DOSHE ECOSYSTEM
DOSHE provides technology and infrastructure that enable users to:
* create accounts and stores;
* publish and discover eligible products;
* communicate;
* facilitate purchases and sales;
* process transactions through integrated payment providers;
* access order and transaction information;
* use available translation, discovery, promotional, and creator tools;
* participate in applicable review and dispute-resolution processes.
DOSHE establishes standards intended to protect transparency, authenticity, trust, and fair participation within the ecosystem.
DOSHE is an ecosystem where individuality becomes value and talent becomes income.

3. ROLE OF DOSHE
Unless expressly stated otherwise, products offered through DOSHE are sold by independent sellers.
DOSHE generally does not:
* manufacture sellers’ products;
* own sellers’ inventory;
* warehouse sellers’ products;
* package sellers’ products;
* physically ship or deliver sellers’ products.
The seller remains responsible for the product, listing, production, fulfillment, and obligations associated with the sale.
DOSHE provides the infrastructure through which transactions are facilitated and may process or facilitate payments, maintain transaction records, establish ecosystem standards, moderate content, verify sellers, review eligible disputes, and take Platform-level action as permitted by applicable policies and law.
Except where DOSHE expressly acts as the seller or applicable law provides otherwise, the underlying contract for the sale of an independent seller’s product is between the buyer and that seller.

4. ELIGIBILITY
Users must have the legal capacity to enter into a binding agreement under applicable law.
Where a user acts on behalf of a company, organization, or other legal entity, that user represents that they have authority to bind that entity.
DOSHE may impose additional eligibility requirements for sellers, particular products, payment functionality, or particular jurisdictions.

5. REGISTRATION AND ACCOUNTS
Users must provide accurate, current, and complete information.
Users are responsible for:
* protecting account credentials;
* maintaining accurate account information;
* activity conducted through their accounts;
* promptly reporting suspected unauthorized access.
Users must not knowingly allow unauthorized third parties to use their accounts.
DOSHE may require identity, business, tax, banking, payment, or other verification where reasonably necessary.
Seller verification may also include evidence relating to authorship, creative process, production methods, workshop activity, or production partners.

6. ACCEPTABLE USE
Users must use DOSHE lawfully and in good faith.
Users may not:
* engage in fraud;
* mislead other users;
* impersonate another person or organization;
* provide false verification information;
* infringe third-party rights;
* sell prohibited or illegal products;
* distribute malicious software;
* manipulate transactions;
* manipulate ratings or reviews;
* compromise or attempt to compromise Platform security;
* interfere with the operation of the Services;
* scrape, access, or exploit DOSHE systems in an unauthorized manner;
* use DOSHE to facilitate unlawful activity;
* intentionally circumvent applicable DOSHE transaction fees in violation of DOSHE policies.
DOSHE may investigate suspected abuse and take proportionate action.

7. HUMAN CREATIVITY, HANDMADE AND ORIGINALITY
DOSHE is designed to support genuine creators and original creative work.
Products represented as handmade must satisfy applicable DOSHE Handmade & Authenticity standards.
Users may not knowingly represent mass-produced or factory-produced merchandise as their own handmade work.
Sellers must accurately represent their role in the creation, design, customization, or production of products.
DOSHE may request reasonable evidence of the creative process and may restrict or remove listings that materially misrepresent their origin.
Detailed requirements are established in the DOSHE Seller Policy and Handmade & Authenticity Policy.

8. ARTIFICIAL INTELLIGENCE
DOSHE recognizes artificial intelligence as a technology that may assist human creativity.
Users may use AI for legitimate purposes such as ideation, creative assistance, editing, visualization, translation, product descriptions, marketing, and other supporting activities.
AI must not be used to materially deceive users about:
* authorship;
* handmade status;
* production methods;
* product appearance;
* originality;
* identity;
* material characteristics of a product.
Where AI materially contributes to a final creative work, appropriate disclosure may be required by DOSHE policy or applicable law.
Users remain responsible for content created or published with AI assistance and for ensuring that they possess the rights necessary to use and commercialize that content.
AI may not be used to:
* generate fake reviews;
* impersonate individuals for fraudulent purposes;
* create deceptive product representations;
* facilitate counterfeiting;
* infringe third-party rights;
* automate fraudulent activity;
* mass-produce listings intended to circumvent DOSHE authenticity requirements;
* manipulate DOSHE systems, rankings, reviews, transactions, or users.
Technology may assist creativity. It must not be used to misrepresent it.

9. USER CONTENT
Users remain responsible for content they upload, publish, transmit, or otherwise make available through DOSHE.
Users must have the rights and permissions necessary to use that content.
Content must not:
* violate applicable law;
* infringe intellectual property;
* intentionally deceive users;
* contain malicious code;
* violate applicable DOSHE policies.
DOSHE may moderate, restrict, disable, or remove content where reasonably necessary to enforce its policies, protect users, respond to valid legal requests, or comply with law.

10. INTELLECTUAL PROPERTY
Creators retain ownership of intellectual property they legally own.
Uploading original work to DOSHE does not transfer ownership of that work to DOSHE.
By uploading content, users grant DOSHE the limited, non-exclusive, worldwide, royalty-free license reasonably necessary to host, reproduce, display, format, translate, distribute, technically process, and promote that content in connection with operating and promoting DOSHE and the user’s store or listings.
This license does not transfer ownership of the user’s intellectual property.
Intellectual property complaints are handled under the DOSHE Intellectual Property & DMCA Policy.

11. TRANSACTIONS
Users participating in transactions must provide truthful and accurate information.
Sellers are responsible for accurately describing products and fulfilling accepted orders.
Buyers are responsible for providing accurate payment and delivery information and for reviewing applicable product and seller terms before purchasing.
DOSHE may maintain transaction records and provide tools intended to increase transparency between participants.

12. PAYMENTS AND STRIPE
Payments through DOSHE are processed using integrated payment infrastructure provided by Stripe and, where applicable, Stripe Connect.
Users may be required to accept applicable Stripe terms and complete Stripe verification.
DOSHE does not represent that it directly stores complete payment-card details where those details are processed directly by Stripe.
Payment processing may be subject to additional requirements imposed by Stripe, financial institutions, payment networks, or applicable law.

13. FEES
Opening a standard DOSHE store is free unless the seller voluntarily selects an expressly disclosed paid service.
DOSHE’s standard Platform Fee is:
5% of each applicable completed sale.
This is the fee charged by DOSHE for operating and providing the ecosystem and its related infrastructure.
Applicable Stripe payment-processing, payout, currency-conversion, international transaction, dispute, or other payment-related fees are separate from DOSHE’s 5% Platform Fee.
Stripe fees are not DOSHE commissions.
Actual Stripe fees may vary according to Stripe’s pricing and the circumstances of the transaction.

14. PAYOUTS
Seller payouts are processed through the applicable payment infrastructure and require successful completion of relevant verification requirements.
Payout timing may depend on Stripe, banking institutions, transaction status, country, currency, verification, refunds, disputes, chargebacks, fraud reviews, and applicable law.
Where contractually and legally permitted, funds may be temporarily delayed, restricted, reversed, or held when reasonably necessary to address:
* fraud;
* chargebacks;
* refunds;
* disputes;
* security risks;
* verification requirements;
* payment-provider requirements;
* legal obligations.

15. RETURNS, REFUNDS AND CANCELLATIONS
Independent sellers may establish their own return, exchange, and cancellation terms within the limits established by DOSHE policies and applicable law.
Seller-specific terms cannot eliminate mandatory consumer rights.
Additional rules are established in the applicable DOSHE Returns, Refunds & Disputes Policy and Seller Policy.

16. DISPUTES BETWEEN USERS
Buyers and sellers should first make a reasonable effort to resolve transaction-related problems directly.
Where direct resolution is unsuccessful, DOSHE may review an eligible dispute.
DOSHE may consider relevant evidence, including:
* listings;
* order records;
* transaction information;
* communications;
* tracking information;
* delivery records;
* photographs;
* videos;
* other relevant documentation.
Within its contractual and technical authority, DOSHE may facilitate or administratively resolve the matter and take appropriate Platform-level action.
DOSHE’s internal dispute process does not constitute a court proceeding and does not eliminate rights that cannot legally be waived.

17. PRIVACY AND PERSONAL DATA
DOSHE processes personal information in accordance with its Privacy Policy and applicable law.
Users who receive another user’s personal information through a transaction may use that information only for legitimate and lawful purposes.
Sellers must not misuse buyer information or use transaction information for unauthorized marketing.
Additional information concerning collection, processing, retention, disclosure, security, and user rights is provided in the DOSHE Privacy Policy.

18. THIRD-PARTY SERVICES
DOSHE may integrate or rely upon independent services including:
* Stripe;
* shipping providers;
* hosting providers;
* analytics services;
* identity-verification services;
* communication technologies;
* security services;
* translation or AI technologies;
* other infrastructure providers.
Third-party services may be governed by their own terms and privacy policies.
DOSHE does not control independent third parties and is not responsible for conduct outside its reasonable control, except where applicable law provides otherwise.

19. REVIEWS AND RATINGS
Reviews must reflect genuine experiences.
Users may not:
* purchase or sell fake reviews;
* use deceptive accounts to manipulate ratings;
* use AI or automated systems to fabricate reviews;
* threaten users to influence reviews;
* coordinate artificial rating activity.
DOSHE may moderate content that violates Platform standards or applicable law.

20. SECURITY AND FRAUD PREVENTION
DOSHE may use automated systems, AI-assisted systems, manual review, verification technologies, transaction analysis, and other reasonable measures to detect fraud, protect users, enforce policies, and maintain Platform security.
Automated tools may assist DOSHE personnel but do not eliminate DOSHE’s obligation to comply with applicable law.
Where appropriate, DOSHE may request additional information before allowing particular transactions, listings, payouts, or account activity.

21. ACCESS RESTRICTIONS
DOSHE may warn, restrict, suspend, or terminate access where reasonably necessary because of:
* serious or repeated policy violations;
* fraud;
* suspicious transactions;
* counterfeit activity;
* material misrepresentation;
* security threats;
* intellectual property violations;
* payment risk;
* prohibited products;
* legal requirements;
* abuse of other users.
Where appropriate and legally required, DOSHE may provide notice or an opportunity to address the issue.
Serious fraud, security threats, or unlawful activity may result in immediate action.

22. SERVICE AVAILABILITY
DOSHE seeks to maintain reliable Services but does not guarantee uninterrupted or error-free operation.
Services may occasionally be modified, maintained, suspended, or temporarily unavailable because of:
* maintenance;
* security requirements;
* technical failures;
* third-party service interruptions;
* legal requirements;
* development of new functionality.
DOSHE may modify functionality as the ecosystem develops.

23. LIMITATION OF DOSHE’S ROLE
DOSHE provides infrastructure, standards, transaction technology, and ecosystem protections.
DOSHE does not guarantee:
* product quality;
* seller performance;
* commercial success;
* sales volume;
* buyer demand;
* continuous availability;
* delivery performance of independent carriers;
* uninterrupted operation of independent third-party services.
Nothing in these Terms excludes or limits obligations that cannot legally be excluded.

24. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, DOSHE will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages arising from use of the Services.
Any limitation applies only to the extent permitted by applicable law.
Nothing in these Terms limits liability that cannot legally be limited or excludes mandatory consumer protections.

25. CHANGES TO THE SERVICES
DOSHE may develop, add, modify, restrict, or discontinue features to improve the ecosystem, respond to security risks, comply with law, integrate new technologies, or adapt to user needs.
Where a change materially affects contractual rights, DOSHE will provide notice where required by applicable law.

DOSHE may update these Terms to reflect changes in:

Continued use after an update constitutes acceptance only to the extent permitted by applicable law and the applicable notice and consent requirements.

These Terms operate together with other applicable DOSHE policies, including:

Where a specialized policy applies to a particular activity, that policy supplements these Terms.

28. GOVERNING LAW
These Terms are governed by the laws applicable to the legal entity operating DOSHE and applicable federal law, subject to mandatory consumer protections and other non-waivable rights.
The final published version should identify the legal operator of DOSHE and contain the applicable governing-law, venue, dispute-resolution, and other legally required business information.

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the maximum extent permitted by applicable law.
